We will schedule installation of your connection once we receive your installation fee. We schedule a full calendar week, seven days, to complete the line install phase, starting after the delivery of your frame-relay/leased-line circuit. INDIVIDUAL ACCESS: You must pre-pay our installation and first month's fee. We will setup your account and contact you with the details you'll need to get connected, generally within 5 business days. You are responsible for obtaining the necessary software to use our services. You will need a TCP/IP "stack" for your computer, and the client software you want to use. Our general recommendation is to buy one of the many "connect to the Internet!" books available in most bookstores that include software. They are usually under $30.00. FULL-TIME, DEDICATED MODEM SERVICES: You should have your own dedicated phone line and modem at your site. FOR ALL SERVICES: Billing for your ongoing monthly services will start once your connection is working, rounded in your favor to the next quarter of a month, or four weeks, whichever comes first. You will receive an invoice for the initial fraction of a month, if applicable. The monthly billing cycle begins on the first of each month. Invoices are mailed out two weeks before the due date, and are due upon receipt. Our terms and agreements are given below. T H E L I T T L E G A R D E N Service agreement SERVICES PROVIDED * Full, unrestricted access to TLG. * Full access to NSFnet and associated regional networks subject to NSF approval and compliance with the NSF Appropriate Use Policy. * Full maintenance of all TLG-owned equipment. TERMS AND CONDITIONS TLG exercises no control whatsoever over the content of the information passing through TLG. You are free to communicate commercial, noncommercial, personal, questionable, obnoxious, annoying, or any other kind of information, misinformation, or disinformation through our service. You are fully responsible for the privacy of, content of, and liability for your own communications. TLG exercises no control whatsoever over the content of the information passing through TLG. TLG makes no warranties of any kind, whether expressed or implied, for the service it is providing. TLG also disclaims any warranty of merchantability or fitness for any particular purpose. TLG will not be responsible for any damages you suffer or inflict on others. This includes loss resulting from delays, non-deliveries, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via TLG is at your own risk. You are responsible for determining whether or not the traffic you originate will end up being carried on another network, and for following the rules of any such networks. TLG specifically denies any responsibility for the accuracy or quality of information obtained through its services. Any access to other networks connected to TLG must comply with the rules appropriate with the other network. This specifically, but not exclusively, includes NSFnet. Use of TLG itself may be for any purpose. Use of TLG for commercial purposes is both permitted and encouraged. PAYMENT The basic idea is that you keep a positive cash balance with TLG. We want to keep paperwork and overhead to a minimum, for our mutual benefit. TLG will send you, via email, a summary of your usage of your connection to TLG, and your balance or amount owed. You must pay any amount owed by the 15th of each month, or TLG reserves the right to interrupt your service until it is paid. TLG will email statements weekly. We recommend you maintain a small positive balance. You can cancel your TLG DialUp-IP service at any time with 7 days notice. We will refund you any overpayment within 30 days. You may request a printed and mailed statement at any time. Payment is due 15 days after date of invoice, except signup fees and first month's service which are due upon receipt of invoice. Accounts are in default if payment is not received within 30 days invoice. If your payment is returned to us unpaid you are immediately in default and subject to a returned check charge of $50 from TLG. Install fees unpaid after after 15 days, or any other account unpaid 30 days after date of invoice may have their service interrupted. Such interruption does not relieve you of the obligation to pay the charge. Only a specific request to terminate your service relieves you of your obligation to pay the monthly account charge. Accounts in default are subject to an interest charge of 1.5% per month, or the maximum allowable under your state's law, on the outstanding balance. If you default, you agree to pay TLG its reasonable expenses, including attorney and collection fees, incurred in enforcing its rights under these Terms and Conditions. TLG reserves the right to change rates and otherwise modify these Terms and Conditions by notifying you 60 days in advance of the effective date of the change. These terms and agreements supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted.
